BEFORE: THE ADMINISTRATIVE REVIEW BOARD

ORDER

   On August 27, 1998, the Administrative Review Board issued a Notice of Appeal and Order Establishing Briefing Schedule in this matter. On September 22, 1998, the Acting Administrator of the Wage and Hour Division filed a Motion to Remand and Suspension of Briefing Schedule. The Acting Administrator conceded that Amfac Resorts, L.L.C. (Amfac), did not have an opportunity to submit certain relevant information to the Acting Administrator prior to his issuance of a final ruling. The Acting Administrator therefore requested a remand in order to consider the information submitted by Amfac to the Board with its appeal and to consider relevant additional information from interested parties. The Acting Administrator requested that the briefing schedule be suspended pending our action on his motion.

   Any party may respond to the Acting Administrator's Motion within five calendar days of receipt of this order. The briefing schedule is suspended pending further order of the Board.
