FINAL ORDER APPROVING CONSENT ORDER
AND DISMISSING COMPLAINT

    Before us for review is the Administrative Law Judge's (ALJ) Decision and Order (D. and O.) issued on November 1, 1995 in this case arising under Section 1101(a)(15)(H)(i)(b) and Section 1182(n) of the Immigration and Nationality Act of 1990, as amended (INA), 8 U.S.C. § 1101 et seq. (1991), and the implementing regulations at 29 C.F.R. Part 507, Subparts H and I (1993). The parties have executed a Consent Order and have requested approval by the Board. Upon consideration of the parties' request, we approve the Consent Order, vacate the ALJ's D. and O., and DISMISS THE COMPLAINT WITH PREJUDICE.

1 On April 17, 1996 a Secretary's Order was signed delegating jurisdiction to issue final agency decisions under this statute and these regulations to the newly created Administrative Review Board. 61 Fed. Reg. 19978 (May 3, 1996) (copy attached).

    Secretary's Order 2-96 contains a comprehensive list of the statutes, executive order and regulations under which the Board now issues final agency decisions. A copy of the final procedural revisions to the regulations (61 Fed. Reg. 19982), implementing this reorganization is also attached.
