ORDER OF DISMISSAL
1. By telegram datd March 4, 1994, Plaintiff filed his
appeal to the District Director's decision of March 1, 1994.
2. By Notice dated March 17, 1994 a hearing was scheduled for
April 14 and 15, 1994 in Indianapolis, Indiana.
3. Respondent's Motion for a continuance was granted and, on
April 19, 1994 this matter was rescheduled for hearing on
September 26 and 27, 1994.
4. By letter received September 13, 1994 the parties provided a
"Stipulation of Dismissal". The settlement agreement upon which
the stipulated dismissal was included, was FAX to me at my
request on September 14, 1994.
5. I have treated the settlement and stipulation as a consent
order under 20 C.F.R. §18.9(c)(2) and Rule 41(a)(1) of the
Federal Rules of Civil Procedure.
6. Accordingly, since the parties to this action have resolved
all issues, including attorney fees and expenses, and have agreed
to a dismissal of this action, I HEREBY ORDER pursuant to 29
C.F.R. §18.9(d), that this action be, and is, DISMISSED.
7. The hearing scheduled for September 26 and 27, 1994 is
CANCELLED.
