Sanjour v. United States Environmental
Protection Agency, 95-CAA-4 (ALJ Oct. 13, 1995)
DATE: 10-13-95
CASE NO: 95-CAA-0004
IN THE MATTER OF
William Sanjour,
Complainant,
v.
The U. S. Environmental Protection Agency,
Respondent,
RECOMMENDED ACCEPTANCE OF SETTLEMENT AND DISMISSAL OF
COMPLAINT
AND
CANCELLATION OF HEARING
The Complainant has signed a settlement agreement
between himself and the United States environmental
Protection Agency under the terms of which he agrees to
withdraw his complaint in this matter in return for the
expunging of a note dated August 5, 1994 from the
Complainant's personnel file, specified changes in the
fiscal year 1994 performance analysis in his personnel
file, permitting the Complainant to add comments to his
fiscal year 1994 performance appraisal, and the agreement
of the Agency to continue to give Sanjour work projects and
tasks that are consistent with his position description.
The agreement appears, on its face, to be fair and
reasonable. No hearings or conferences having been held in
this matter, I have no opinion regarding what appears on
the f ace of the document. It is noted that both parties
were represented by counsel.
It is recommended that the settlement agreement
reached between the parties on March 23, 1995 be approved,
[PAGE 2]
and that the complaint in this matter be dismissed.
The hearing in this matter scheduled for November 6,
1995
in Washington, D. C. is hereby cancelled.
