ORDER OF DISMISSAL
This matter is before the undersigned following the
Administrative Law Judge Joel R. Williams' return of the case to
the unassigned docket pending his imminent retirement. By
submission dated January 2, 1996, the parties[1] filed a
stipulation of dismissal pursuant to Fed. R. Civ. P.
41(a)(1)(11). See Lepore v. East Bay Municipal Utility,
94-CER-3 (Sec'y Feb. 15, 1995). Accordingly,
IT IS ORDERED that the administrative proceedings in this
matter are hereby DISMISSED.

The stipulation is signed by the attorneys for both parties.
Bryan Decker signed the stipulation on behalf of the Complainant.
Judge Williams, in his Order Granting Continuance indicated that
r. Decker had been removed as counsel by the Complainant. By
facsimile transmission dated January 11, 1996, however, the
Complainant confirms that he has retained Mr. Decker and consents
to the stipulation of dismissal filed by Mr. Decker.
