Complainant, Ron Lowe, Respondent, Teamster's Local #390, and the Occupational Safety and Health Administration, as a party in interest, have each executed and filed, pursuant to Rule 41(a)(1)(ii), a Stipulation of Voluntary Dismissal with prejudice in resolution of the complaint filed in this proceeding under the Surface Transportation Assistance Act, 49 U.S.C. §31105. Upon consideration of the Stipulation and in accordance with the Secretary's decision in Monroe v. QJ Transfer and Storage, 89-STA-4 (1989), therefore:
IT IS ORDERED that this matter be, and it hereby is, dismissed with prejudice.
