             ORDER APPROVING SETTLEMENT AND DISMISSAL OF CASE

     This case arises under the employee protection provisions of
the Surface Transportation Assistance Act of 1982 (STAA), 49
U.S.C. §2305, wherein the Complainant, Kenneth Baker, filed
a complaint with the Secretary of Labor, alleging that the
Respondent Goodness Green, had discharged him from his employment
for engaging in protected activities.  The case was scheduled for
hearing on July 19, 1995 in Chicago, Illinois.  The hearing is
hereby cancelled, as the parties have advised that they have
reached a settlement and requested a dismissal of this case.

     On August 19, 1995, counsel for the Respondent submitted a
proposed Settlement Agreement and requested that the matter be
dismissed with prejudice.  I have reviewed the settlement
agreement and find it to be fair, adequate, and reasonable.  It
is therefore,

     ORDERED that the request for a dismissal is Granted and the
Settlement Agreement, a copy of which is attached hereto and made
a part hereof, is approved, and the case is hereby Dismissed with
Prejudice.  It is further ordered that each party shall bear its
own costs and expenses.
