DECISION AND ORDER - GRANTING MOTION TO DISMISS

     A hearing in this matter under section 405 of the Surface
Transportation Assistance Act of 1982 ("the Act"), 49 U.S.C.
§2301, et seq., 29 C.F.R. Part 1978, having been duly
noticed for Portland, Oregon, on October 24, 1995, pursuant to
Complainant's objections to the 'Secretary's Findings" dated July
28, 1995, Complainant, through his attorney, filed a Motion to
Dismiss his complaint on October 11, 1995.  Accordingly, on the
basis of Complainant's written withdrawal of his objections, the
Secretary's Findings are affirmed, the scheduled hearing is
cancelled and the complaint is dismissed. 29 C.F.R.
§1978.111(c).

SO ORDERED.
