This case has been brought under under Section 110(a) of the Comprehensive Environmental Response, Compensation and Liability Act, 42 U.S.C. §§ 9610; Section 507(a) of the Federal Water Pollution Control Act, 33. U.S.C. §§ 1367; Section 1450(l)(1)(A-C) of the Safe Drinking Water Act, 42 U.S.C. §§ 300j-9(i); Section 23(a)(1-3) of the Toxic Substances Control Act, 15 U.S.C. §§ 2622; and; and Section 211 of the Energy Reorganization Act of 1974, as amended, 42 U.S. C. 5851; and under rules set forth by 29 C.F.R. Part 24.
The Complaintant is represented by Steven Novick, Esq., Tulsa, Oklahoma. The Respondent is represented by Richard L. Waters, Esq., Law Department-Litigation Division, Kerr-McGee Corporation, Oklahoma City, Oklahoma.
On October 16,2001 the Complaintant moved for an Order of Dismissal, upon submission of a "Dismissal With Prejudice" of this claim. Apparently the claim will be dismissed with prejudice and without provision of payment for fees and costs to either party.
Therefore, it is hereby ORDERED that the instant case is DISMISSED as moot.
