RECOMMENDED ORDER APPROVING WITHDRAWAL OF COMPLAINANT'S REQUEST FOR FORMAL HEARING AND DISMISS THE INSTANT COMPLAINT

    On February 18, 2004, Complainant faxed a letter to the undersigned indicating a desire to pursue other legal remedies rather than a hearing against Respondent for violation of the Water Pollution Control Act, 33 U.S.C.1357 and the Safe Drinking Water Act, 42 U.S.C. 300j-9(i). In accord with 29 C.F.R. § 18:29 Fed. R. Civ. P. 41, I hereby grant Complainant's request and recommend dismissing the instant complaint.
