In this case arising under the employee protection provision of the Energy Reorganization Act of 1974 (ERA), 42 U.S.C. §5851 (1988), the Administrative Law Judge (ALJ) issued a Recommended [Order of] Dismissal on January 16, 1998. The ALJ entered his Order based on the Complainant's request -- by and through counsel -- to withdraw his complaint prior to hearing. Respondent did not object to Complainant's request to withdraw the complaint. We approve the ALJ's recommended Order. Accordingly, the complaint in this case is DISMISSED.
