This case arises under Section 405, the employee protection provision, of the Surface Transportation Assistance Act of 1982 (STAA), 49 U.S.C.A. § 31105 (1994). On June 21, 1995, the Administrative Law Judge (ALJ) issued a Recommended Order of Dismissal when Complainant, after two days of hearings, moved that his complaint be dismissed with prejudice and Respondent's counsel did not object to the dismissal with prejudice. In accordance with the ALJ's order and pursuant to 29 C.F.R. § 24.5(e)(4)(ii), this case is DISMISSED WITH PREJUDICE.
