On November 3, 1999, the Administrative Law Judge (ALJ) issued a Decision and Order Approving Settlement and Dismissing Complaint in this case which arises under the Surface Transportation Assistance Act of 1982 (STAA), 49 U.S.C.A. §31105 (1994). Pursuant to 29 C.F.R. §109(c)(2) (1997), the Board issued a briefing schedule and the parties were invited to submit briefs in support of or in opposition to the ALJ's decision. As neither party submitted briefs, the Board has adopted the ALJ's decision and this case is CLOSED.
